1. Introduction
This privacy policy explains how Carlos Avilés ("we," "us," or "our") collects, uses, and protects the information generated by your use of the Flying Calmly mobile application (the "App"). Our goal is to be transparent about the data we collect, to protect your privacy, and to help you understand your rights.
Flying Calmly does not require you to create an account, and we do not collect your name or other directly identifying personal information. We are committed to data minimization and collect only what is necessary to provide and improve our service.
2. What Information We Collect
We collect the following types of information:
- Anonymous Usage Data: To help us understand how our App is used, we collect anonymous data about your interactions. This includes your flight search history, your subscription status, voluntary payments, and device language settings. All of this data is associated with a randomly generated anonymous user ID (UUID) that is created on your device and is not linked to your personal identity.
- Flight Monitoring Data (Flying Calmly PLUS): When you track a flight — and in particular when you use the PLUS subscription's live monitoring features — the App sends the flight's identifying details (such as flight number and date) and your anonymous UUID to our servers. Our servers use this information to retrieve flight schedule and position data from third-party flight data providers, to generate and update your turbulence forecast. This flight information relates to flights, not to you personally, and is not linked to your identity. Flight monitoring data is retained on our servers only for as long as needed to provide the service, and for a short period thereafter, after which it is deleted.
- Subscription Data: If you subscribe to Flying Calmly PLUS, your purchase is processed by Apple. We never receive or store your payment card details. The App communicates your subscription status (for example, active or expired) to our servers, associated with your anonymous UUID, so that we can provide PLUS features and stop monitoring flights when a subscription ends.
- Push Notification Token: If you enable notifications, the App registers an anonymous device push token with Apple's Push Notification service so we can send you forecast updates. This token is not linked to your personal identity.
- Voluntary Survey Data: From time to time, we may offer an optional in-app survey. If you choose to participate, we collect your responses to help us better understand our users. This may include your user profile (e.g., "Nervous flyer"), your reason for using the App, and your flight frequency. As part of the survey, you have the option to provide your email address to receive updates. Providing your email is completely voluntary.
3. How We Use Your Information
The information we gather has two primary purposes: to provide the App's forecasting and monitoring features, and to improve and personalize your experience with Flying Calmly. Specifically, we use it to:
- Generate and update turbulence forecasts for the flights you track, including live updates for PLUS subscribers.
- Provide and manage the Flying Calmly PLUS subscription and its features.
- Analyze usage patterns to improve the App's core functionality, performance, and usability.
- Understand the different types of users we have and their unique needs through optional surveys.
- Guide the development of new features tailored to specific user groups.
- Send you occasional updates about new features, but only if you have explicitly consented by providing your email address.
4. Our Legal Basis for Processing
For the optional collection of your email address, our legal basis is your Consent. You provide this consent freely and explicitly by typing your email address into the provided field. You can withdraw this consent at any time by clicking the "unsubscribe" link in any email you receive from us.
For the processing of flight monitoring data and subscription status, our legal basis is the performance of a contract — that is, providing the forecasting and monitoring features you have requested or subscribed to. All other usage data is processed anonymously to pursue our legitimate interest in improving our service.
5. Data Sharing and Third Parties
We do not sell your personal data. We share data with third parties only as necessary to provide the service:
- Flight Data Providers: To monitor your flights and generate forecasts, we send flight details (such as flight number and date) to third-party flight data providers, including Flightradar24 and Cirium (FlightStats). This data relates to flights and is not linked to your personal identity. These providers process the data under their own terms and retention rules.
- Weather Data: Our forecasts are generated using publicly available weather data, including data from NOAA/NWS and ECMWF.
- Apple: Subscriptions and payments are processed by Apple under Apple's own privacy policy. Push notifications are delivered through Apple's Push Notification service.
- Analytics: The anonymous, aggregated usage and survey data may be analyzed using standard analytics tools to identify trends.
- Email Provider: If you provide your email address, it will be stored in a secure, GDPR-compliant email service provider for the sole purpose of sending you the updates you requested.
6. Data Retention
We retain anonymous usage and survey data for as long as it is useful for improving the service. Flight monitoring data retrieved from third-party providers is retained only for a short period necessary to deliver the service and is then deleted, in accordance with our data providers' requirements. If you provide your email address, we retain it until you unsubscribe.
7. Your Data Rights
We are committed to providing all our users with clear rights over their data. You have the following rights regarding your personal data:
- The right to be informed: To know how we use your data (as explained in this policy).
- The right of access: To ask for a copy of the information we hold about you.
- The right to rectification: To correct any inaccurate information we hold about you.
- The right to erasure: To ask us to delete your personal data. Please note that we can only identify and delete your data using the anonymous UUID associated with your app installation. If you delete the app, this UUID is lost, and we will no longer be able to identify or delete your past anonymous usage and survey data.
- The right to restrict processing: To limit how we use your data.
- The right to data portability: To receive your data in a machine-readable format.
- The right to object: To object to our processing of your data.
- The right to withdraw consent: To unsubscribe from our feature updates at any time.
